Agreement Between User and Senate Holidays Private Limited
Applicability
This User Agreement along with Terms of Service forms the terms and conditions for the use of services and products of Senate Holidays Private Limited (SHPL).
Any person (“User”) who inquires about or purchases any products or services of SHPL through its website, mobile applications, offices, call centers, branch offices, franchisees, agents, or other customer channels (collectively referred to as "Sales Channels") agrees to be governed by this User Agreement.
Eligibility to Use
The User must be at least 18 years of age and legally capable of entering into a binding agreement to use SHPL’s services.
If a minor wishes to use the Website or Sales Channels, such use must only be made under the supervision of a parent or legal guardian.
Content
All content available through SHPL’s Sales Channels, including but not limited to text, images, audio, icons, and software, is protected under applicable intellectual property laws.
Users are not permitted to copy, modify, distribute, or commercially exploit any such content without prior written permission from SHPL.
Website Usage
The Website is intended for lawful and genuine use only. Users shall not misuse, interrupt, attempt to hack, or exploit the Website or any of SHPL’s Sales Channels.
Users must provide accurate and complete information while registering or making bookings.
Bookings by Travel Agents
Except where expressly authorized by SHPL, travel agents, aggregators, or resellers are not permitted to use the Website for resale or commercial bookings.
SHPL reserves the right to cancel such bookings without notice if unauthorized commercial usage is detected.
Limited Liability of SHPL
SHPL acts primarily as a facilitator connecting Users with service providers such as airlines, hotels, transport operators, and other travel-related service providers.
SHPL’s responsibility is limited to providing booking facilitation and confirmation. Any issues with actual service delivery remain the responsibility of the concerned service provider.
User’s Responsibility
Users are advised to review booking details, service descriptions, and applicable terms carefully before making any booking.
If booking on behalf of another traveler, the User must ensure that such traveler is informed of all relevant terms and restrictions.
Security and Account Information
Users are responsible for maintaining the confidentiality of their account credentials, passwords, and any related login information.
SHPL shall not be liable for unauthorized access resulting from negligence on the part of the User.
Fees and Payment
In addition to the booking amount charged by service providers, SHPL may levy convenience fees, service fees, taxes, and other applicable statutory charges.
Refunds, where applicable, shall be processed according to the cancellation and refund policies of the relevant service provider and subject to receipt of funds from them.
Communication Details Usage
SHPL may use the User’s mobile number, email address, or other communication details to send booking confirmations, updates, cancellation notices, payment status, refund information, or other transaction-related communication.
Insurance
Unless specifically included in a service or package, obtaining adequate travel or related insurance remains the sole responsibility of the User.
TCS Compliance
Users booking overseas tour packages may be required to comply with applicable Tax Collected at Source (TCS) provisions under Indian law.
Compliance with Liberalized Remittance Scheme (LRS)
For international transactions, Users may be required to provide PAN details and comply with applicable RBI regulations under the Liberalized Remittance Scheme (LRS).
Obligation to Obtain Visa
For international travel, obtaining valid visas, transit permits, or “OK TO BOARD” approvals is solely the User’s responsibility unless otherwise expressly arranged by SHPL.
Force Majeure
SHPL shall not be held liable for cancellations, delays, or inability to provide services due to events beyond its control, including natural disasters, pandemics, strikes, government actions, or technical failures.
Advertisers and Linked Websites
SHPL may provide links to third-party websites or display advertisements. SHPL is not responsible for the content, services, or privacy practices of such third-party websites.
Right to Refuse
SHPL reserves the right to refuse service, reject bookings, or suspend access to the Website if the User is found to be in violation of this Agreement or any applicable law.
Right to Cancel
SHPL may cancel any booking if it believes that the booking is unauthorized, fraudulent, or based on false or misleading information provided by the User.
Fraud / Fake Calls / Phishing
SHPL’s employees or representatives will never ask Users for passwords, OTPs, CVV numbers, or request money transfers to personal bank accounts.

Indemnification
The User agrees to indemnify and hold harmless SHPL, its affiliates, directors, officers, employees, and representatives from any claims, losses, liabilities, or damages arising from the User’s misuse of services or breach of this Agreement.
COVID-19 Related Terms & Conditions
Travel and hospitality services may be impacted by government regulations, health advisories, and safety requirements relating to COVID-19 or similar public health situations.
Users are responsible for complying with all applicable health, travel, and documentation requirements before and during travel.
Content Moderation
SHPL may moderate user-generated reviews, images, and responses to ensure compliance with community standards, legal requirements, and platform integrity.
Recommendation System
SHPL may use recommendation systems to display properties, services, or travel options based on search filters, past interactions, popularity, user ratings, price, and other relevant factors.
Miscellaneous
- Severability: If any provision of this Agreement is found invalid, the remaining provisions shall continue in full force.
- Jurisdiction: This Agreement shall be governed by the laws of India and disputes shall be subject to the jurisdiction of courts in Delhi.
- Amendment: SHPL reserves the right to update or modify this Agreement at any time.
- Confidentiality: Confidential information shared by SHPL shall not be disclosed except as required by law.
- Feedback: SHPL may contact Users for feedback regarding services and experiences.
- Privacy Policy: Users should also review SHPL’s Privacy Policy available on the Website.
Grievance Redressal
If any User feels that their concern has not been resolved satisfactorily, they may escalate the issue to the Grievance Officer.
